Renting out label E, F or G after 2029: will there be a ban?

By Renewable Partners B.V. · Published and updated:

Under the current draft decree there will be no blanket, nationwide ban on renting out a home with label E, F or G after 1 January 2029. However, municipalities will be given the power to enforce via the Decree on Buildings in the Living Environment, with a penalty order (last onder dwangsom) as the ultimate measure. Because the decree has not yet been finally adopted, the exact enforcement route may still change.

No ban, but a standard and oversight

The cabinet deliberately chose not to introduce a usage ban, so that tenants would not become the victims of possible eviction as a result of a poor label. Instead, the requirement of at least label D becomes a standard in the Bbl, which municipalities can enforce against the landlord.

Enforcement in principle runs via the municipality's regular building and housing inspection chain: identification, issuing a notice to the owner and, in case of continued non-compliance, a penalty order. This is in line with how municipalities already act against other Bbl violations.

What this means for your risk assessment

Because there is no ban, as a landlord with an E, F or G label after 2029 you do not automatically run the risk of no longer being allowed to rent out the home. The risk lies in the notice, the deadline set by the municipality to still carry out sustainability measures, and the costs of a penalty order if you do nothing.

In addition, a poor label already has an effect before 2029 on the WWS points count, resulting in a lower maximum rent. The financial incentive to pursue sustainability measures therefore runs parallel to, and ahead of, Bbl enforcement.

    • No nationwide rental ban in the current draft decree.
    • Enforcement runs via the municipality: notice, remediation period, possible penalty order.
    • The exact enforcement procedure has not yet been finally established.
