Under the Affordable Rent Act, a self-contained home with more than 186 WWS points falls in the free sector; up to and including 186 points a statutory maximum rent applies. If your home sits close to the threshold, an accurate assessment decides whether you may set the rent freely. Homes with energy label E, F or G face an additional restriction.

The thresholds
Up to 143 points a self-contained home is in the lowest segment; from 144 to 186 points in the mid segment. Above 186 points there is no statutory maximum per point. The amounts per point total are in the Huurcommissie rent thresholds.
For homes with a poor energy label (E, F or G) additional rules may prevent free-sector letting despite more than 186 points. See our article on the mid-rent threshold and the label requirement.
Worked example (fictitious)
A fictitious home is self-assessed at 189 points. Measurement shows a 4 m² storage room was wrongly counted as a room: 4 × (1 − 0.75) = 1 point less, so 188 points. The home stays above the threshold.
Had the same error been 16 m², the difference would be 4 points and the home would score 185: a maximum rent then applies.
What this means for you
Around 186 points every point can decide between a maximum and a free rent. Have the home surveyed on site before setting a rent above the mid segment.
